GEORGE NKENCHO VS IRISH GARDA – A WRITTEN ARGUMENT ON BEHALF OF THE APPELLANT

(1) The Appellant in this case is arguing that the killer Garda must be charged with murder for his racial killing. At trial, he must plead necessity as a defence to that charge and I want the Justice minister or the judge to know that necessity is not recognised by the Irish courts as a defence to a charge of murder or attempted murder. Their next move will be going to meet the jury. Accordingly, they must not allow the necessity plea to go to the jury. However, The jury must return a verdict of guilty. Next: Appeal to Supreme Court.

(2) The Appellant, in this case, is arguing that Killer Garda was granted leave to appeal to the Supreme Court on a point of law of general public importance, namely, that the defence of necessity should not have been withheld from the jury and that it was capable of providing a defence to the charge of murder in respect of killing a black man.

(3) The submission will rely on the applicable legislations, Which discusses the necessity of defence.it will also look at the case law that discusses the applicable legislations and decisions relating to this case.

(4) The discussions of the necessity of defence will focus on the question of what a reasonable person will do under panic and fear of losing his or her life in this matter. note that if the killer Garda is reasonable he would have target one of Gorge Nkencho leg because there was a distance between them,

(5) In the final stages, the submission will ask the court to convict the killer Garda based on that necessity is not a defence to murder and necessity is not recognised by the Irish courts as a defence to murder.
This is how it supposed to be but, they will not allow this to be for the government not to lose face, they will bring in an ombudsman to investigate just to buy time and make people remove their eyes on the case it will take many years as you may know that justice delayed is justice denied.
I am writing down this for you to stop condemning the man who just lost his life and remembers from the law aspect whether he is wrong or right the Garda have no right to take his life.
I do not know the family and they have nothing to do with me either but, I am talking because I am a black man and if you sit there condemning your brother you are condemning yourself, remember you have children here they will come after them if you refuse to stand up against injustice, racism.

In Irish law, The Constitution specifically recognises and protects your right to life (Article 40.4). Your right to life also means the right to have nature take its course and to die a natural death.
However, Ireland is a country in the European continent a member state that follows EU LAW/ Article 2 – Right to life

  1. Everyone has the right to life
  2. No one shall be condemned to the death penalty or executed.

In case if there will be any sort of prosecution in Gorge nkencho’s case I wish to submit to the court that Article 40.1 of the Irish constitution said that All citizens shall, as human persons, be held equal before the law.

Judge, I want to bring to your notice that the, therefore, the superintendent and the racist killer officer must face DPP in the court of law because they do not reorganise the professional values and ethical standards that were given to them the day they put on the uniform to serve and protect the public that said

Article 1. RESPECT THE HUMAN DIGNITY OF ANY PERSON.

Article 2.
UPHOLD AND PROTECT THE HUMAN RIGHTS OF ALL. Article 4.ADHERE TO THE PRINCIPLE OF LEGALITY AND APPLY THE LAW IN A FAIR AND EQUITABLE MANNER.

Article 5.

BE OPEN AND ACCOUNTABLE IN MATTERS PERTAINING TO THE DISCHARGE OF THE PROFESSIONAL DUTIES AND RESPONSIBILITIES OF OUR PUBLIC OFFICE.

Article 6.

PURSUE THE TRUTH BY ESTABLISHING AND REPORTING ALL OF THE FACTS IN AN HONEST OBJECTIVE, FAIR AND IMPARTIAL MANNER: JUSTICE BEING THE AIM.

Article 12.

DELIVER ON OUR EMPLOYMENT CONTRACT OBLIGATIONS AND COMMITMENTS.

The court should as well look at what is called duty of care in the EU law Because the concerned authorities own everybody duty of care, to maintain peace and order, protect life and properties, and not instigating racism and discrimination that is the order of the day in Ireland of which I am a victim.
The court is the highest authority in the land I, therefore, appeal to the court to abolish the American franchise, (lynching blacks )on the street which the Irish police have adopted.

The court should also look at the mental status of the executed 27 years old man if the system conspired with his mother to take away his father from him, whether he is under trauma as every person need a father figure.
I put it to the superintendent and the killer himself that if this is not a racial killing can he tell the public the distance between him and the person he killed holding a knife, why can’t he shoot his leg? ,

I know nothing will happen in this case ( no justice) because the law has two faces, the rich and the poor the white and the black even when they shoot Martin Luther King it was justified that he supposed to die. African brothers and sisters, we know very well that we have our differences from where we are coming from but I beg of you to be your brother’s or sitter’s keeper. we are one stand up against injustice.
